Clause 1: Purpose
The general terms and conditions of sale described below detail the rights and obligations of the company and its customer in connection with the sale of products: sports equipment/clothing and various accessories. By placing an order, you declare that you have read and accepted these General Terms and Conditions of Sale; all orders are subject to product availability and acceptance of the order by the company.
Clause 2: Prices
The prices of the goods sold are those in effect on the day the order is placed. They are expressed in euros and include all applicable taxes.
The company reserves the right to modify its prices at any time. However, modifications will not affect orders that have already been confirmed.
Clause 3: Payment Methods
Payments can be made by credit card or PayPal. Your order will be processed once payment is confirmed. In the event of non-payment, the company reserves the right to cancel the order.
Clause 4: Right of Withdrawal
In accordance with the provisions of Article L. 221-18 of the French Consumer Code, the customer has a period of thirty (30) days from receipt of the goods to exercise their right of withdrawal without having to justify reasons or pay penalties, with the exception of return shipping costs which remain their responsibility. Subject to legal withdrawal conditions.
To exercise their right of withdrawal, the customer must notify the company of their decision to withdraw through an unambiguous statement using the withdrawal form available on our website.
In the event that the right of withdrawal is exercised within the aforementioned period, the company undertakes to refund the customer the full amount paid. The refund will be made using the same payment method as that used by the customer for the initial transaction.
The customer must return the goods to the address provided to them upon contact, without undue delay and, in any event, no later than thirty (30) days after communicating their decision to withdraw. This deadline is deemed met if the customer returns the goods before the expiry of the thirty (30) day period.
The right of withdrawal does not apply to goods excluded by law, including personalized items, goods liable to deteriorate rapidly, or sealed goods that cannot be returned for health protection or hygiene reasons if they have been unsealed after delivery, etc.
Article L221-28 of the French Consumer Code stipulates that the right of withdrawal does not apply to goods unsealed by the consumer that cannot be returned for reasons of hygiene or health protection.
- If they have been worn or their packaging has been unsealed, the seller may refuse their return for hygiene reasons, provided that this restriction is mentioned in their general terms and conditions of sale (T&Cs).
- If the socks are new, unworn, and still in their original packaging, the consumer may exercise their right of withdrawal and request a refund or an exchange.
Clause 5: Delivery
Delivery is made to the place specified by the buyer when ordering, and shipping costs are indicated at the time of order.
The delivery time specified when placing the order is provided for guidance only and is in no way guaranteed; consequently, delivery times may vary depending on destination and product availability.
Any reasonable delay in the delivery of products shall not entitle the buyer to damages and/or order cancellation.
Transport risk is not insured by the company.
In the event of missing or damaged goods during transport, the buyer must file a claim immediately upon receipt of said goods. These reservations must be submitted in writing by email within five days following delivery.
Clause 6: Liability
The company cannot be held liable for direct, indirect, special, consequential, or punitive damages resulting from the use of its products.
Clause 8: Force Majeure
The company cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale arises from a case of force majeure. In this regard, force majeure means any external, unpredictable, and irresistible event within the meaning of Article 1148 of the Civil Code (health crisis, natural disaster, etc.).
Clause 8: Competent Jurisdiction & Applicable Law
Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law.
Failing an amicable resolution, the dispute will be brought before the competent court of the relevant city and its surrounding area.
Clause 9: Amendments to the T&Cs
The company reserves the right to modify these General Terms and Conditions of Sale at any time. Modifications will take effect immediately upon publication on the website.
